These Terms govern access to and use of PM Career Lab, operated by Opeyemi Akinlolu trading as McBilly Exploits. By activating an account or using the service, you agree to these Terms and the Privacy Policy.
1. Eligibility and authority
You must be at least 18, legally capable of entering a contract, and authorised to accept these Terms for yourself or any organisation you represent. Access is invite-only unless we state otherwise.
2. The service
PM Career Lab is an educational simulation platform for practising product, project, programme, and transformation-management work through fictional scenarios, stakeholder interactions, ceremonies, decisions, work products, coaching, and assessments. Features may be changed, suspended, or retired.
3. Accounts and invitations
You must provide accurate information, keep credentials confidential, use only your own account, and promptly notify us of suspected unauthorised access. Invitations and entitlements are personal, may expire, and may not be sold, transferred, or shared. You are responsible for activity under your account unless caused by our breach.
4. Acceptable use
You must not:
- Break the law, infringe rights, harass, discriminate, deceive, or cause harm.
- Upload malware, probe security, evade access controls, interfere with the service, or attempt unauthorised access.
- Scrape, copy, reverse engineer, resell, sublicense, or commercially exploit the service except where law expressly permits.
- Impersonate others, share accounts, manipulate assessments, or misrepresent simulation outputs as independently verified professional work.
- Enter real confidential, classified, sensitive, special-category, client, employer, patient, customer, or government data into fictional scenarios.
- Use AI features to create illegal or harmful content, extract protected system instructions, or defeat safety, budget, or kill-switch controls.
5. Educational purpose; no professional advice
Content, feedback, scores, hints, and AI output are for education and practice. They are not legal, financial, medical, employment, compliance, or other professional advice and do not guarantee qualification, certification, employment, promotion, earnings, or any workplace outcome.
6. AI features
AI output may be inaccurate, incomplete, biased, or unsuitable. You must exercise judgment and verify material information. We may restrict or disable AI features to manage safety, quality, availability, or cost. Do not rely on AI output for high-impact decisions or submit data you are not authorised to share.
7. Your content and licence
You retain rights in original content you submit. You grant us a worldwide, non-exclusive, royalty-free licence to host, copy, process, display, adapt, and analyse it only as necessary to operate, secure, support, assess, and improve the service and to comply with law. You confirm that you have the necessary rights and that your content complies with these Terms.
8. Our content and intellectual property
The service, software, scenario design, fictional data, rubrics, branding, documentation, and other materials supplied by us are owned by or licensed to McBilly Exploits and protected by law. We grant you a limited, personal, revocable, non-transferable right to use them for authorised learning. No other rights are granted.
9. Feedback
If you provide suggestions or feedback, you permit us to use them without restriction or payment, while we remain responsible for our handling of any personal data included.
10. Cohorts, facilitators, and administrators
Where an organisation or facilitator sponsors access, authorised facilitators and administrators may view learner progress, work products, transcripts, evidence, scores, feedback, and audit records within their assigned scope. They may manage invitations, cohorts, phase gates, prerequisite bypasses, and score overrides where their role permits. Their actions may be logged.
11. Assessment and portfolio use
Scores and competency indicators are based on configured evidence and may include automated assistance and human review. You remain responsible for checking exported portfolio material, removing information you should not disclose, and describing honestly how it was produced.
12. Fees and payment
If paid plans are introduced, prices, taxes, billing frequency, renewal, cancellation, and refund terms will be shown before purchase. Except where law requires otherwise, fees already paid are non-refundable. We may suspend paid access for overdue amounts after reasonable notice.
13. Third-party services
The service relies on third-party hosting, database, identity, email, payment, analytics, support, security, and AI providers. Their availability and separate terms may affect features. We are not responsible for third-party services you access independently.
14. Confidentiality and fictional data
Scenarios are fictional and do not represent real organisations or people. You must keep non-public platform materials, security information, and cohort data confidential and may use them only for authorised participation.
15. Availability and changes
We aim to provide a reliable service but do not promise uninterrupted or error-free operation. We may perform maintenance, impose usage limits, correct content, or change features. Material changes to these Terms will be identified by a new version and may require re-acceptance.
16. Suspension and termination
You may stop using the service and request account closure. We may suspend or terminate access for breach, security risk, non-payment, legal requirement, misuse, or discontinuation of the service. Where reasonable, we will give notice and an opportunity to remedy. Provisions intended to survive, including intellectual-property, liability, and dispute terms, continue after termination.
17. Privacy and data protection
Our Privacy Policy explains our processing, retention, sharing, security, international transfers, and your rights. You must use the service in a way that complies with applicable data-protection law.
18. Disclaimers
To the fullest extent permitted by law, the service is provided “as is” and “as available”. We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability. Nothing excludes rights that cannot lawfully be excluded.
19. Limitation of liability
To the fullest extent permitted by law, McBilly Exploits is not liable for indirect, incidental, consequential, special, exemplary, or punitive loss, or loss of profits, revenue, opportunity, goodwill, or data. Our aggregate liability arising from the service will not exceed the amount you paid for the service during the 12 months before the event giving rise to the claim, or the minimum liability that applicable law requires where no fee was paid. These limits do not apply where liability cannot lawfully be limited.
20. Indemnity
To the extent permitted by law, you will indemnify McBilly Exploits against third-party claims, losses, and reasonable costs arising from your unlawful use, your content, or your material breach of these Terms.
21. Governing law and disputes
These Terms are governed by the laws of the Federal Republic of Nigeria. Before starting formal proceedings, the parties should attempt in good faith to resolve a dispute by written notice and discussion. Subject to mandatory law, Nigerian courts have jurisdiction.
22. General terms
These Terms and the Privacy Policy form the agreement about the service. If a provision is invalid, the remainder stays effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganisation or transfer of the service. Electronic notices and records are acceptable.
23. Changes
We may update these Terms for legal, security, operational, or product reasons. The displayed version and effective date identify the terms in force. Material updates will be notified appropriately and require a new acceptance before continued use.
